Terms & Conditions

§ 1 Scope

These Terms and Conditions apply to all contracts for the letting of hotel rooms for accommodation, as well as to all other services and supplies of Hotel am Theater UG (haftungsbeschränkt), hereinafter referred to as the “hotel”.

The Terms and Conditions apply to all guests, booking parties, accompanying persons and visitors, as well as to companies, tour operators and other contracting parties.

Deviating terms of the guest or of the contracting party apply only if they have been expressly confirmed by the hotel in writing.

§ 2 Contracting parties and conclusion of contract

The contracting parties are the hotel and the guest, or the party placing the booking.

An accommodation contract is concluded as soon as the hotel confirms the booking, a room has been booked bindingly through a booking portal, or the guest actually makes use of the hotel’s services.

If the booking is made by a third party on behalf of the guest, the booking party is liable jointly with the guest for all obligations arising from the accommodation contract, to the extent permitted by law.

§ 3 Services, prices and payment

The hotel is obliged to keep available the rooms booked by the guest and to render the agreed services.

The guest is obliged to pay the prices agreed for the provision of the room and for the further services made use of by the guest.

The prices that apply are those agreed at the time of booking or displayed through the respective booking portal.

All prices are inclusive of value added tax at the applicable statutory rate, insofar as such tax is payable.

Additional services such as breakfast, parking, late departure, special cleaning, additional persons or other services may be charged separately.

Invoices issued by the hotel are due for payment in full immediately upon receipt, unless another arrangement has been agreed. The hotel is entitled to require an advance payment, a credit card guarantee or a security deposit on arrival or before arrival.

§ 4 Arrival and departure

Check-in is possible from 15:00 on the day of arrival.

Check-out must take place by 11:00 at the latest on the day of departure.

Earlier arrival or later departure is possible only with the prior consent of the hotel and may incur additional charges.

In the event of late departure without prior agreement, the hotel may charge the following amounts:

  • until 18:00: up to 50 % of the current daily room rate;
  • after 18:00: up to 100 % of the current daily room rate.

The guest remains entitled to prove that the hotel has suffered no loss or a substantially lower loss.

§ 5 Digital check-in and access to the hotel

The hotel may use digital check-in systems, access codes, electronic keys or other automated access systems.

The guest is obliged to provide the data required for check-in completely and truthfully.

Access codes, keys, key cards or digital access credentials must not be passed on to unauthorised third parties.

In the event of loss, misuse or passing on of access credentials, the guest is liable for any resulting damage, insofar as the guest is responsible for it.

§ 6 Cancellation, no-show and early departure

The cancellation conditions agreed at the time of booking apply.

Where the booking was made through a booking portal, the cancellation conditions displayed and accepted there apply in addition.

In the event of late cancellation, no-show or early departure, the hotel’s claim to the agreed remuneration remains in place, to the extent permitted by law.

The hotel will set off expenses saved and income from letting the room to another party, to the extent required by law.

§ 7 Use of the rooms

The hotel rooms may be used exclusively for accommodation purposes and only by the registered guests.

Passing the rooms on to third parties, subletting, use for commercial purposes, photo or film productions, events, parties or any other purposes not agreed upon is prohibited without the prior written consent of the hotel.

Unregistered overnight guests are not permitted. In the event of a breach, the hotel may charge additional overnight fees and exercise its house rights.

§ 8 Registration duty and verification of identity

The guest is obliged to provide all registration data required by law completely and truthfully.

Where required by law, in particular in the case of foreign guests, the hotel may require presentation of a valid identity document and record the registration data prescribed by law.

If data required by law is refused or provided incompletely, the hotel may refuse accommodation.

§ 9 No-smoking policy

Hotel am Theater is a non-smoking hotel.

Smoking is strictly prohibited throughout the entire building. The smoking ban applies in particular in:

  • hotel rooms,
  • bathrooms,
  • corridors,
  • stairwells,
  • communal areas,
  • entrance areas,
  • at windows,
  • on balconies, where smoke may drift into the building or into other rooms.

The smoking ban also applies to e-cigarettes, vapes, shishas, tobacco heaters and comparable products.

In the event of a breach of the smoking ban, the hotel charges a flat-rate sum in damages of €250.00.

The guest remains entitled to prove that the hotel has suffered no loss or a substantially lower loss.

The hotel reserves the right to claim any actual costs going beyond that amount in addition. This includes in particular the costs of:

  • special cleaning,
  • odour removal,
  • ozone treatment,
  • cleaning of textiles, mattresses, curtains and furniture,
  • periods during which the room cannot be let,
  • loss of income,
  • fire brigade call-outs,
  • damage caused by triggered smoke detectors or fire alarm systems.

§ 10 Pets and animals

Bringing pets or other animals into the hotel is generally not permitted.

This applies to all rooms, public areas, corridors, breakfast areas and other parts of the hotel.

Mandatory statutory exceptions remain unaffected.

If an animal is brought in without authorisation, the hotel charges a flat-rate sum in damages of €250.00.

The guest remains entitled to prove that the hotel has suffered no loss or a substantially lower loss.

In addition, the hotel may charge all costs actually incurred, in particular for:

  • special cleaning,
  • disinfection,
  • removal of animal hair,
  • odour removal,
  • cleaning or replacement of textiles,
  • damage to furniture, floors, doors or fittings,
  • periods during which the room cannot be let,
  • loss of income.

The hotel is entitled to refuse the continuation of the stay with the animal and to exercise its house rights.

§ 11 Damage and exceptional soiling

The guest is liable for all damage and soiling caused by the guest, by accompanying persons, visitors or other persons attributable to the guest. This applies in particular to damage to:

  • furniture,
  • beds,
  • mattresses,
  • bed linen,
  • towels,
  • carpets,
  • floors,
  • walls,
  • doors,
  • windows,
  • technical equipment,
  • sanitary installations,
  • keys,
  • access systems,
  • decoration,
  • other hotel property.

Exceptional soiling that goes beyond ordinary use is charged according to the actual effort involved. This includes in particular:

  • vomit,
  • blood stains,
  • heavy soiling of mattresses or furniture,
  • urine or other bodily fluids,
  • stains that cannot be removed,
  • strong odour contamination,
  • deposits of rubbish,
  • food remains to a considerable extent,
  • unauthorised smoking,
  • unauthorised keeping of animals.

The hotel may claim compensation for special cleaning, disinfection, replacement, repair, periods during which the room cannot be let and loss of income.

§ 12 Loss of or damage to keys and means of access

In the event of loss of, damage to or failure to return keys, key cards, access chips or other means of access, the guest is liable for the costs incurred. This covers in particular the costs of:

  • replacement keys,
  • replacement of lock cylinders,
  • reconfiguration of electronic access systems,
  • security measures,
  • working time and administrative effort.

§ 13 Quiet hours, conduct in the hotel and house rules

The guest must behave in such a way that other guests, staff and neighbours are not disturbed, endangered or harassed.

Quiet hours apply between 22:00 and 07:00.

Parties, loud music, disruptive behaviour, excessive consumption of alcohol, drug use, violence, threats, insults or damage to property will not be tolerated.

In the event of serious or repeated breaches, the hotel is entitled to terminate the accommodation contract without notice, to require the guest to leave the premises and to issue a ban from the premises.

The hotel’s claim to remuneration remains in place in such a case, to the extent permitted by law.

§ 14 Alcohol, drugs and dangerous items

The possession, consumption of or trade in illegal drugs is prohibited throughout the hotel.

Bringing in dangerous, highly flammable, explosive, strongly smelling or health-endangering substances is prohibited.

In the event of a breach, the hotel is entitled to inform the competent authorities, to terminate the stay immediately and to claim damages.

§ 15 Parking

Parking spaces are provided, where available, subject to availability.

There is no entitlement to a particular parking space unless this has been expressly agreed in writing.

The hotel is not liable for theft, damage, vandalism or loss of vehicles or of items left in them, unless the damage is due to intent or gross negligence on the part of the hotel.

§ 16 Lost property

Items left behind are forwarded only on request and at the guest’s expense and risk.

The hotel keeps lost property for a reasonable period. Thereafter it may be realised or disposed of in accordance with the statutory provisions.

Food, hygiene articles and perishable goods are not kept, for reasons of hygiene.

§ 17 Liability of the hotel

The hotel is liable for damage arising from injury to life, body or health in accordance with the statutory provisions.

For other damage, the hotel is liable only in the event of intent, gross negligence or breach of material contractual obligations, to the extent permitted by law.

The hotel is liable for property brought in by the guest in accordance with the statutory provisions.

Valuables, cash, jewellery, electronic devices and important documents must be kept secure by the guest with due care.

§ 18 Data protection

Personal data of the guest is processed exclusively within the framework of the applicable data protection laws.

§ 19 Consumer dispute resolution

The hotel is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 20 Final provisions

German law applies.

Should individual provisions of these Terms and Conditions be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected.

The place of jurisdiction is Gera, to the extent permitted by law.

Governing language

The German version of these Terms & Conditions takes precedence. In case of doubt, the German version shall be taken as reference.
